Like lots of other state level rulings that conflict with Federal policy or law, this starts it's little trip through the courts, with a stay of enforcement until the matter is settled. To the US Supreme Court it goes.
At the moment the Feds are only concerned with the financial angle( IRS) because the overwhelming number of improperly paid 1099 workers never pay their Fed income and SS taxes. Same with state level income taxes.
What is driving this movement now, particularly in California but other places as well is the trend towards trying to force employers and companies to provide benefits(health ins, retirement, higher minimum wages, family leave etc), in other words the progressive agenda popular in segments of the electorate.
They can't get it voted in, so activist judges are their only play. -

I’m Not for or against.... I personally wouldn’t do a maga lease . And I’ve read a couple.
None of those leases meet the ABC requirements. So those guys should be classified as company drivers.
2 separate checks from carrier one for the leased equipment and one for the driver.....they will never do that.Last edited: Aug 18, 2018
