Unfortunately, it's not that simple. For instance, if someone were convicted of child molesting, how much time would it take for you to feel it was okay for him to be around your daughter unsupervised? In all fairness, I would say never! So, you have to draw the line somewhere. To go waaaay back, before all the controversy, that was the point I was trying to make: It's your job to see that when the line is drawn, you're on the right side of it. You do that by meeting it head-on in an effort to see that a fair evaluation is made. That's what I try to do (coupled with some duckin' 'n' dodgin').

ok, i did not read every post on here. federal law, if it is over 7yrs, a employer can not ask you that question and you are not required to answer it. if any employer refuses you work becuase of it, you have legal grounds to sue. they play the game because back in the day, lot of your convicted felons were not educated and unaware of thier rights. most today are not aware as well so the game keeps going on. the only ones whom you are required to answer yes to is an actual gov't positon job, or any job with the law or fire, emt, or hospital. Truck driver even though it falls under FMCSA and Dept of Transportation and the U.S. Marshals, it is not a govt job, you do not recevie your pay check from the govt. I would contact your lawyer or get one, and have them start filing papers to sue or to get your record cleared up.

forgot to include. if its a felony with a weapon or drug related its upto 10 yrs.

all your required to say when asked if you will run canada is yes or no. you do not have to give a reason. companies are now using that as a way around the laws because they have been sued. so if a company asks are you able or willing to go into canada, just say no, nothing more. if your behinde in child support, you cant go into canada, and alot of our misdemeanor's will keep you from going into canada as well. if you read on the applications, is says, have you ever been convicted of a felony in the last 7 or 10 yrs. if worried about canada, find a company that does not run canada, there are still alot of them.

yeah i have noticed that on apps to.have you ever been convited of a crime if so list dates and crime committed etc.i think most companies know how to word it so they dont set themselves up for a lawsuit

that is correct. they look at it as if your willing to answer, then hey, thanks. just remember, you do have rights and are protected under federal law. remember, they are a company, ever heard of a company that plays by the rules, or fair? so when you do things, think like them, watch how apps are written or how they speak to you. they all use word games to slip you up. I learned all this when i stepped into a management job and had to also learn HR as well. Trucking companies for what ever reason, seam to think that they can play by a whole diffrent set of rules but, they cant. it was a shock for me and still is. all we can do is look after one another because they will shaft us as fast as they can. good luck and hope the info has been helpful. 1 thing i would recomend, do a free counsel with a lawyer to confirm that the laws have not changed, this way you know, as we all know, laws change, and sometimes without ever hearing about it.
