Can anyone help me out here

    From what Ive read your brother needs to find a job with no stress. A good place to look is a subway sub shop. I am not kidding here. This is a very stressful job and for someone to be having problems he really needs to stay out of trucking until everything is taken care of. I would not let him drive for me if he was seeing a Psychiatrist that lets you know right there he needs a lot of rest.

    OK, you mentioned time sheets and log book - are you referring to the same thing here? was he working local or OTR? you mentioned working 40 hours over what was legal...70+40 perhaps? which comes out to 110? when I was with a flatbed company, I routinely put in around 90-100 hours a week - home on weekends. if he isn't willing to put in these kind of hours, he isn't going to be a truck driver. and a company can't "make" you work if you don't want to.

    you mentioned his being stressed, angry and frustrated. this is not a good combination for a driver of a 40 ton vehicle. and if he expressed this to his company, is this justification for firing him? maybe, maybe not. but these days companies do NOT have the luxury of dealing with an employee with a lot of drama. he didn't want to work the following week - they could argue that he was quitting. most companies want a few weeks notice for a driver to go on vacation. you're not describing any physical symptoms that would qualify for medical leave. but I could be wrong about that.

    you also mentioned he hasn't paid his child support, hasn't paid his mortgage and is now living with your parents. what does this have to do with PGT?

    as far as unemployment - you may want to reconsider. unemployment doesn't pay very much and doesn't pay for very long. and a lot of companies ask on the application if you've ever received unemployment benefits. I don't think they should be able to ask you this, but they may use it to avoid hiring people who might end up exercising their rights to compensation.

    I wish your brother the best. maybe being unemployed for the next couple of years will allow him to relax, rest and mellow out a bit.

    No #### ! Especially those drivers who try to make a buffet out of one sandwich.

    How those guys and gals manage to fit the entire line up on one bun...is beyond me.

    I'm tired, and don't feel like making a long post, so I will make this short and to the point.

    If all this is true, get your brother to a hospital for an MRI or CAT scan immediately. He has no assets, no money. Have the hospital social worker help him get on Medicaid.

    In the condition he is in, he does not need to be in a truck, no matter how badly he needs money.

    Companies lie all the time. Every dollar paid out on unemployment is that much less operating capitol they have.

    LoL....not all subway's are in travel centers. Just not a lot of stress in a job like that.

    Just a thought here; Has it occured to anyone that maybe PGT is opposed to having someone that could be perceived as mentally unstable behind the wheel of their equipment?
    Try to get your minds around the ramifications of that. Rather than convince these people they need a lawyer, maybe someone should be encouraging this guy to get help with his mental health.

    I think the suggestion to go seek medical treatment immediately is right on. Sounds like there is an issue that should be addressed and waiting is not going to fix. There are ways around it if he has no money.

    When your brother told management he was stressed, frustrated and angry and wanted a week off, that sent up a big red flag. Then the icing on the cake was when he said he would be delayed to a meeting because he had an appointment with a shrink that morning. A trucking job requires a driver to be 100%, not 80%. You said you have power of attorney, is there a reason for that? Generally, that means the person doesn't have it all going on and cannot fend for himself. So someone he trusts makes his decisions legally.

    Which will cause the bigger waves... firing a driver thats having a meltdown or having a driver thats having a meltdown go into bumper to bumper Dallas traffic?
