Can I get some sympathy here?

Great post aftershock! Examiners flippin splitters...?! I'd bet that actually happened at one time or another, but not a fare characterization of examiners. I'd imagine that most would agree that 99 percent and change of examiners are highly trained and professional. How exactly would that happen in the first place? Like you said... If the student did notice that lame trick, why wouldn't they simply check it there and then. And if they didn't notice it when and if it happened, how could they be sure it really did? Regardless, the lesson should be to check your splitter before you shift. At least when you're taking your test. Unless there's points for that too!

If the examiner flipped the paddle to the wrong position, wouldn't that indicate that the paddle WAS in the proper position in the first place -- indicating that the driver had, in fact, checked the splitter, and it WAS in the correct position?

And, IMO, if the splitter WAS in the proper position, the driver shouldn't have to worry about the examiner changing things for ANY reason.

If that stunt resulted in a nervous driver rolling back, and into a car behind the trailer, or snap a U-joint, who would the examiner blame that on? I bet they wouldn't fess up, and the driver's career could end right there before it ever got started.

I'd call that a "set-up" by the examiner to fail a wannaBee.

Or

WannaBee arrested for opening a can-0-whup on D.M.V. Examiner.

But ANY juror with a driver's license would probably never come back with a guilty verdict. Not if they've spent ANY time at their D.M.V. -- standing in line for hours -- only to be told they're in the wrong line, go back and start from the beginning again.

that was the very first lesson I learned on this hear board. You do NOT monkey with another man's ride.

If you are in the hot seat, YOU play with the toys. Somebody else monkeys with 'em and it's gonna take a week for them to track down on the fingers along the highway.

DMV examiner would be walking back to the shop with my shoe protruding next to his wallet, too. At the very best, that action is unprofessional. At worst, it's deadly.
