Cargo Van HOS/Scale Question

    If your property carrying vehicle is used for business (in the furtherance of any commercial enterprise) and:
    1) has a Gross Vehicle Weight RATING of 10,001# or more, or
    2) transports HM in a quantity which requires placarding
    ... then you fall under the CMV regulations (log book, medical card, etc.).

    To use "sleeper berth" in your log your sleeping facilities must meet the requirements in 393.76.

    Unless you are over 10,000 lbs. GVWR you are exempt from all FMCSR UNLESS you carry an amount of hazmat requiring placarding . I'd avoid hazmat altogether in a cargo van . It isn't carried often enough to be worth the hassle . If you accept a hazmat load your log will have to show all on duty hours worked the past 7 days because you will be under the 70 hours in 8 days rule .
