I couldn't really think of another forum or thread to post this to so I hope this doesn't piss anyone off.
I was driving my personal vehicle to work where I use my class A license and a companies box truck made a u-turn right in front of me on a highway causing an accident. He missed his turn and decided to slow down so I got in left lane to pass there after he whipped truck around and dragged me for 15 feet. Other than pulled muscles and extreme increases to stress levels I am alright but probably should have been dead. My car is totalled I was making payments on it through the dealership($3,500 before paid off). I failed to do something with insurance so it was expired in mid June. This happened August 9th. I was moving into a new place on the 13th and was going to start a new insurance policy then.
I know I am stupid and this should not have happened but if there is any advice legally for my situation I would be stoked to hear it.
My thoughts on the matter are I am happy I am alive. I was taught never to make a u-turn on a highway road during cdl school a year ago. My job requires a class a license if I decide to press charges or make a claim I believe my license record will be marked or taken away... My dealership is going to want to know car is totalled and in a tow yard. I'm pretty scared of the idea of driving on public streets now. I spoke to one injury claim firm and they said they do not want to represent me because of lack of insurance... All I know that I want from this is to be kosher with my credit and class A. Id Iike my hospital bill taken care of. If I could get back what I have put into the car would be great but I dont know if that is what is deserved. If you were driving without insurance, legally you weren’t supposed to be there in the first place. You not only will be out your vehicle and probably at minimum a big ticket for driving uninsured, but you could be paying for damage to his truck as well if they really decided to push it.
Best advice is just take the loss and shut up about it and pray for the minimum legally. The more feathers you ruffle over this could cause you more ####. Just hope for it to go away and learn your lesson.MartinFromBC, dunchues, Western flyer and 3 others Thank this. -
It depends on state law. Check with an attorney who specializes in auto accidents and other problems including litigation. 10/4

BTW, if you have CDLs and yet you were driving around in your personal vehicle without insurance, your actions are inexcusable. If I were a judge, I d just have that truck owner cover your car and deny any medical claims because YOU know better.brian991219, TROOPER to TRUCKER, tinytim and 3 others Thank this. -
File a claim against the trucking companies insurance if they were found at fault.

The trucking company would be in the clear in my state. You can sue anyone at anytime for any reason. Check your state laws in reference to the type of accident. Question was you accident a t bone or sideswipe etc.
