If you live in a state with “no pay, no play” laws, uninsured drivers are prevented from suing for damages that can’t be quantified with a dollar amount. These include physical pain, emotional distress and mental suffering.
Uninsured motorists in “no pay, no play” states also may have to pay a massive deductible toward repairs before they can sue for property damage costs — that is $25,000 in Louisiana, for example.
States with “no pay, no play” laws are:
- Alaska
- California
- Indiana
- Iowa
- Kansas
- Louisiana
- Michigan
- Missouri
- North Dakota
- New Jersey
- Oklahoma
- Oregon

Secondly it don't matter if the police says the other party is at fault. The other party probably will lawyer up and the insurance may want to come after you. I would seriously consult legal advice never mind you didn't have insurance at the time. They must prove your intent on not having sufficient coverage. In discovery if it goes that far the attorney can capture a financial profile to find out if this is a fraud case. Take your case to the most popular ambulance chaser; if they take you on then you might have a shot.

Call an accident attorney and you’ll get all your questions answered. Once you get an attorney the company’s insurance will settle.
