I was arrested for DUI in 1984, I took a 1st offenders program which amounted to a nolo contendre deal. If I was not stopped again in 5 years there would be no record of any conviction, but if I got stopped again in that 5 year period, I would be working on my second offense.

I never got stopped again so now that 28 years have gone by, I just answer the questions the application asks. Some carriers ask if you have ever been CONVICTED of DUI... I answer No, some ask if you have ever been ARRESTED for DUI, I answer yes, Some ask if you have ever FAILED a drug or alcohol test, I answer yes, Some ask if you have ever REFUSED a drug or alcohol test, I answer no...

Just tell the truth and answer the question they ask. Usually there is a place to explain briefly what happened.

I did that with my first trucking job. I didn't mention a couple little misdemeanors with no conviction. Got a call from the recruiter asking about the arrests. Now I always mention them if they ask "have you ever been arrested". They were nearly 20 years old...LOL
