You do not mention how your brother was using his cell phone. California does have a law against using a cell phone (without a hands free device) even for non-commercial drivers. Simply holding the cell phone can get you the ticket regardless of whether or not you are engaged in a call. Today's cell phones have hundreds of features. California does not want you holding that cell phone while you are driving. They do allow for the use of a single button that causes a hands free device to answer a call or place a call using voice recognition.

I think we both replied to the same post...you were just a little quicker on the draw. I didn't even see your misinformation until I clicked to post my response, and by then I had already posted the correct info (with a credible source), so I let it slide....figured you'd be along to correct your mistake. You usually have a decent enough grasp on the rules & regs to steer people in the right direction...

I may be mistaken but I'm under the assumption that any rule pertaining to a CDL holder would be the same in a commercial vehicle or a private vehicle. Have some beers while at home and get stopped your limit is the same as if you were in your truck. I'm thinking the same would go for phone usage if the cop wanted to push it.

You are mistaken, there is no such legislation that carries rules that pertain to the operation of a CMV over to the operation of a personal vehicle.

He never said how he was using it and I didn't think to ask him about California's ban on them in all vehicles.

That is illegal! Plus can you imagine the work it would take to go through every driver's phone records, every month, AND match the times up with when EVERY truck was in drive??? I don't think so.
