you got divorced, you were making 100,000 a year and pay 25,000 in child support. but we all know that the economy dictates wether you pay your bills or not. your job has been eliminated. no chance of ever coming back. so you take a new profession and are now only making 25,000 per year. after taxes you can't pay what you were originally ordered now.
and don't say find another job making that same amount. cuz my statement said that position is no longer available with that income. ANYWHERE.

Yeah I'll have to agree. He clearly has no clue and has either a) never paid child support b) never had a money grubbing welfare queen for an ex wife c) never been acquainted with the family court system in a state that historically and as a matter of practice and policy caters to the mother. d) all of the above.
I was inimately knee deep in b and c lol I never had a chance. Worse yet, in many of these states they come after and harass guys like the op ( and myself ) because we play by the rules. We pay. We work. They know how and where to find us. They don't have to expend resources to track us down to get us into court. While how many tens of thousands that owe tens of thousands get away with it because they fly under the radar and get paid under the table and never end up in court. It's because the state has to expend too many resources to find them and make them pay up.
They op clearly is trying to do the right thing but it also has to be equitable and leave the guy something to pay his bills with. -
Yes I did a little more research and as said. Some states will not consider it income, but some will depending on the situation. They don't only ask for W2's they ask for Pay stubs. Pay stubs have your Per diem on it if your company takes it out of your pay. I was paid almost 13,000 in Per diem last year. I'm trying to remember its been 6 years but I could swear my lawyer used my per diem when they were calculating child support, but I'll go back to the child support calculator and check.

Per diem effectively lowers your taxable income. Every state is different. IN my state they have used my w-2 to figure my child support obligation. The per diem is listed on my w-2 but is is listed in box 13. the actual amount of the per-diem is deducted from my gross income. When mine was calculated they only used my gross taxable income. per-diem was not added into the calculation.
You need to consult with an attorney and let them handle the court and getting your obligation reduced. In my experience, (16 years dealing with family court) everytime I went to court on my own, I got screwed. Once I hired an attorney and let them handle it for me I got the result I was looking for.BeanDip Thanks this. -

my experience is not all father's who doesn't pay child support are not dead beats I have 2 kids me and my ex was not married and she lives in another state now because we wasn't married I have no legal rights to my kids at all it would cost me 10,000 to even start to get rights I have to get them legimated then pay for my lawyer and a lawyer for the kids I have talked to a lawyer in the state she is in he told me 10,000 that is how I know and that is just to start well I don't have that kind of money she doesn't let me see them well she did let me see them for about 3 months of last year then she got to where she would have me tell them I would come get them the SHE WOULD TELL ME NO hmm I wonder what she told the boys be it wasn't she said no the last time I told my oldest I would be there Friday to pick them up that was on a Monday the next day her phone number was changed and so was her cell phone number she had it fixed where I couldn't get the numbers I have begged her to take me out for child support but she wont because then I would have some legal rights and she doesn't want me to have any rights to them at all

I went to the Texas attorney general's office along with my girls mom to start child support deductions. They take 140.77 a week. I honestly don't even notice it's gone. I even help out with extra money when needed. It's no big deal.
