Thank you again, I've previously read about the 90-96 and tried my best to understand it. I have a lot of questions for my P.O. but I haven't yet got a chance to sit down and ask him everything I've wanted to. My first official appointment with him is on the 11th of this month. I try explaining to these companies but they don't seem to care or act as if I'm lying to them. They just say things like "misdemeanors must be 5-7 years old" even when I say I'm not actually convicted, then I had one recruiter say "charges pending" is just as bad as I'm too much of a risk for the insurance company to cover me. I've even had 4 or 5 of the people I talk to say my charges are ######### and weed should be legal, I just choose to do something safer than alcohol and its raining hell down on my head. If only I would of been in one of the legal medical marijuana states I would be considered someone who grows medicine, instead of a druggie criminal hazard to society.

THAT right there is about as close to the truth as one has gotten to for you.
That "charges pending" is big. You are in a limbo status for most and that sucks for an employer. Scares them away when they have to deal with an "unknown."
Now, with THAT in mind. Talk to your PO and see how you can address that point. You can't say you were convicted, but you can't say you were innocent either. And that's the limbo that the 90-96 is putting you into. -
Yeah that is the tricky part, hard to know exactly how to put that down on a application too. Pot doesn't seem so serious till you have to deal with the legal system. It's like someone said its bad when its laws against the drug do much more harm than the drug itself.

DJ. When filling out job app and they ask you if you have ever been convicted of a crime you will need to answer yes. Even with the outcome of not being quilty you pleaded quilty to get the lessor chargeand according to the little green book, that is considered a conviction. I was in the same postion(not with drugs) I filled out a job app said I was not convicted( according to MD state law I was not convicted but by pleading quilty to get a Probation Before Judgement DOT regs said I was quilty). My lawyer had told me to put no to any question asking if I ever was convicted of a crime, he didn't know and I didn't know until I was fired for lying on job app because of this misunderstanding, so now my dac reports keep me from getting a driving job with those companies that use dac.

Do not call. Show up well dressed and with a resume, especially to the smaller local companies. A lot of times they do not even have listings that they are hiring. Trucking is one of the last "good-ole-boy" industries where they would rather have someone walk through the door, shake their hand and tell them why you would be a fantastic asset to their company.

To Mack attack: Yeah I already had one company tell me that when I put no they considered it lying and turned me down even after I explained my story and I'm sorry you had to learn it that way, getting fired for a misunderstand and that going on your DAC report is pretty unsettling.
To bknight: I'd like to go that route with a couple of the companies who are closer to me but I live in a small town and I dont have many to choose from. Its a little harder with me being broke and I can't hardly afford groceries let alone gas to drive around to every company just to hear no 9 out of 10 times. I really do feel as if I'm between a rock and a hard place and now of course I have to give court $1200 and pay my PO $40 a month and I was told I have to pay to do community service. -
If you don't get something soon your CDL will be useless and you'll have to pay for a refresher course . Even then there's no guarantee you'll make it through orientation and training .

OP, look into getting a class-B job driving a concrete mixer, and work your way up into the bulk hauling side. Since you have the class A, you may end up filling in for bulk hauler call-ins and vacations and eventually get a permanent slot. I'm told that those concrete companies hire a bunch of people with quite a varied past.. -
for OP - Felony convictions reviewed on a case-by-case basis - so at least at that company one can get to being considered with even worse than what you claim, or at least it seems so but the email address bounces so for my part that company will not get further effort from me ....

STOP applying to mega-carrier companies. You obviously are serious about trucking, just spend every day reading EVERY Craigslist, newspaper, jobfair add you can find. You will find a small mom and pop with 2 or 3 trucks. Talk to them, let them know you are serious about sticking with someone who will give you a chance. Get on the phone and just "cold call" some small companies, ask if they know anybody looking for a driver. STOP TALKING TO THE MEGA-CARRIERS you are just a steering wheel holding monkey to them.
