    I was inclined to negotiate with the creditor instead of going to court. But I was also wondering about their insistence of setting out of court ...

    It's probably not insistence - more like a really strong suggestion.

    On the other hand, if it's in court, the JUDGE determines how much you pay per month (and total, as I recall). If they negotiate it themselves, they have a bit of a stronger hand there.

    On the gripping hand, going to court over it will be a black mark in the credit report, I'm told.

    So, it's going to depend on your own situation. If you feel in a strong enough position to negotiate head to head, I'd do it. If you are not, the judge MAY take pity and give you a reasonable schedule.
