Completely empty, headed to residence, on PC

    The problem with Personal Conveyance is that it is not a regulation but rather the absence of regulations that allow it. PC exists only in guidance documents from the FMCSA leaving it up to interpretation by every Officer out there without any black and white regulation or law to point to.

    The links below are the only place PC exists, as FMCSA guidance with a question and answer format to provide some idea of what the FMCSA finds acceptable under the concept of "if it is not prohibited then it is permitted".     These two sorta contradict each other
    If I deliver and I am going home where I plan to not be dispatched for at least my 34
    Then it looks like I can PC since at the last delivery I was completely relieved of duty and had no other load booked

    I answered your question, and @ZVar elaborated with the actual regulation.

    Because you weren't supposed to be using PC in the first place, as stated many times in this thread, and now once again.

    I try to avoid Rutherford like the plague but one day they had a couple cops or dot?? On and we’re talking about this sorta stuff

    Even they with their own answers said

    But the regulations are not gray. And they dictate the rules over PC, not the other way around. Whether an officer gives you a ticket or not or even misquotes the regulations, is at their discretion. Doesn't change the regulations or interpretation by a court of law.

    And therein lies the problem with PC not being an actual regulation but rather the absence of regulations relying on guidance instead. It would be much simpler if it were actual regulation with clear cut limitations on use.
