Not all the time, there has to be an attempt on the one party part to communicate the danger they are in to the other contracted party so to first allow a mitigation of the danger in the future and to rectify any issues that impact the first party. And if there is no action, then a contract dispute could be raised.

In other words ...

Sitting on how someone drives recklessly and then trying to get out of the contract based on that observation means little. without communicating to the company immediately and providing proof that they are driving recklessly pretty much doesn't mean there is a possibility of voiding the contract.

Making a u turn and damaging the flaring on the truck doesn't constitute a danger, stupidity yes but not a danger.

My argument is not about a danger. It is about the illegal U Turn. A person cannot be compelled to be an accomplice to an illegal act. The U turn was illegal. That may or may not have put the co driver in harm's way but it would make him party to a crime. Yes, I no it is a stretch but I would also point out that courts are for disagreements and as a lawyer, *which I am not, I would get paid even if I am wrong.

 

I hope this makes sense, talking and typing isn't always good to keep focused.

I understand what your point is but it is moot, the u turn is assumed illegal but the actions of the driver doesn't make the second driver participating in a crime because this isn't a criminal act, it is a motor vehilce operator violation and doesn't apply to a second person who has no control under the law no matter what because the laws are written that only one person can be in control of the vehicle at one time. With the second driver in the sleeper and logged as such it further distances the driver from being active in controlling the vehicle.

Nevertheless If the first driver said " ah ... dude I've got two kilos of coke in your bag, I put it there because the other ten are in mine" and the second driver did nothing, then he participated in the crime or if he discovers it after being inspected and it is found, it can be construed as the second one is willing participate.

 

If OP came to you, small fleet owner, about a driving job, would you hire him? Why or why not?

 

I would have no problem hiring him provided he has a felony. Right now that is all we are hiring and actually not hiring until February.

What we are doing is giving people a second chance by hiring folks who can not get a break. I am a felon myself albeit a felon whose case has be reversed. We are trying to do the business correctly. The plan is to buy new equipment and teach the business of trucking to those we hire. I believe we will have the most loyal employees out there. Right now we are gathering data on the base way to proceed. We expect to be running more then 1 truck on February 25 of next year.
