Then driver refuses to drive the truck. To me thats what this is all about, to stop drivers from running company trucks that aren't fit to be run.

Since points will be put on the driver, they will start refusing to run when company tells them to or face lossing their CDL if the get to many points. And yes I know alot of guys will be forced to do it or be fired, so there needs to be something in place to prevent this from happening.

I agree, but as it is now, the driver is the only one that will be paying the price.

There is no protection for them to allow them to not drive the truck. Many companies will be firing on the spot. It is sad out there anymore.

I've already been warned by west virginia dot for my medical card not being legible enough. They said when the new rules go into effect it was going to be a major ticket. They were also sympathetic as every truck driving relative they had was going to be quitting when the rules start.

    Good luck with Habib, mike.

    Speaking only for myself here:
My company doesnt force me to drive junk equipment, overweight loads, or over hours! BUT they do make sure to pay me so little that I cant AFFORD to tell them "NO"! The desire to keep my family clothed, fed and sheltered forces me to operate outside the rules from time to time. BUT BEFORE ANYONE SAYS I am overextended fianancally, let me tell you how we live. I have 3 kids still at home, all teenagers. We have NO credit cards, no car payments, no student loans, no bills other than food and utilities. We dont smoke, drink, eat out, or even have cable tv. My "new" car, the only vehicle we own btw, is a 14 year old full size Ford van we bought from the State of Ohio at auction. We paid $545 cash for it and then took the amber "bubblegum lights" of the van and got $150 for them on Craigs list!
My wife works for a major home improvement retail chain and makes about $12/hr. (which sometimes is more than I make btw). Our total expenses are around $3000 a month, which I dont think is bad for a 5 person family! But believe it or not, we fall short every month! If I have more than 3 days a month off.we cant pay bills! I CANT turn down any loads! I CANT sit in the shop, getting the truck worked on, I DONT WASTE time on the road!
Now, I have to worry about proper form and manner too???
This just another tactic to get rid of us older drivers and replace them with fresh meat who will do the job for less money. The big companies and their lobbyists have convinced the rulemakers to do their dirty work for them, all in the name of safety!
And what choice do I have? Like most of us out here, all I can do is keep trying to survive and adapt until the inevitible day when I can either no longer pass the ever stricter medical standards or Mike or one of his peers declares me "unfit" and I lose my CDL! I have no other option to ride this burning wreck all way to the end of the road! AINT TRUCKING GREAT???

No matter what the intention of the new rules are, it will boil down to one thing. Companies will hire new driver mill students because they will work cheap, will do what they are told, when they are told, and most importantly, will come with a clean driver score.

Drivers that have been around a few years will more than likely have some points, so off they go, just like the newbie will be as soon as he gets his points. The unintended (hopefully not purposefully) consquences will be more new drivers on the road just because of their zero score.

If most big companies go to electronic logs, and hire new drivers for less pay, then their expenses will go down. How many fewer people will be needed in the log department once electronic logs are standard, and the payback is greater than the expense. It's easy to say to a driver to keep his nose clean, but the more miles and time on the road, the higher the chances of getting hit. My score is zero, luckily, but who knows what could happen tomorrow, and I get dingeed for my carrier not maintaining equipment properly.

BTW, I have met some very nice, very fair DOT, who went out of their way to keep from writing me tickets, as I have ran into the other kind also. Thankfully the good far outweighed the bad.

If I wasn't so old I would love to get into enforcement. I have sat in line at the scales and watched trucks in the other line that Mr. Magoo could see should be parked, yet off they went. In truth, we have all gotten by with more than we have gotten caught at.

As usual, the driver is a very responsible person. Anything goes wrong and he is responsible. Even if he is no the one making the decisions.

My husband has worked for 8 companies in as many years.

One cheated with every check, the next one was great but closed their doors.
Then we got another local one going, but they slowed down to much in the winter..

the next long haul was good, but they sold out to some jerks who wouldn't fix a #### thing! Even with a DOT officer telling them the exhaust leak was BAD, they would not fix the truck!

We then went back to the same old local boy, but he got laid off come winter..

went to another long haul, and had to deal with the SSDD, not fixing anything attitude.

Then the next company canned him for refusing to run a truck that even one of the boys from down south of the border would not touch...(That truck was SCARY! Don't hit any bumps... something WILL fall off!)

Came back to another local boy...I've never seen anyone cheaper!! He wins the penny pinching contest! If it ain't 100% necessary to make that truck roll down the highway, it ain't getting fixed!

Now we are back to the same old local boy who my husband goes back to every time.

And when this goes into effect, all the "Hey Officer, can you check this out?" that he had to pull to get some moronic owner/shop manager/dispatcher to fix something is going to count against my husband and this good old country boy who does keep his equipment up to snuff??

Ya know, if they are gonna implement this kind of ####, the least they can do is wipe the slate clean for stuff like that, because it isn't right to have to count this against people who were innocent.

And I really want you to know this and understand it!! YOU JUST TOOK AWAY A DRIVERS MOST EFFECTIVE WEAPON AGAINST CHEAPSKATE, MINIMAL REPAIR COMPANIES.

It was supported by the ATA.

This is mainly for the mega carriers. It is not going to affect them the least. They will claim even when documented, the driver drove it without their knowledge.

Thank goodness, the DOT will stop all of the drivers from risking their lives.:biggrin_25510:
