Question? How is your company getting the data that is required per the FMCSA that goes in the driver's qualification file? This data is the same data hireright has.

I find it funny as I answer everyone I receive....
Hire-right doesn't have everything on every driver -
My very last orientation was a number of years before I retired. I will never forget the lady that ran it and what she said about the paperwork. She said there was a lady back in the home office HR dept that gets angry and tosses paperwork that is not complete or is not right. This is the result of how heavy-handed the FMCSA has got about 391.2XUturnGirl Thanks this. -

Go ahead make fun of DAK and the even the rules set up. Just for craps and giggles make contact with your closest regional FMCSA office and ask what can happen if those files required by 391.2X are not there or are not complete. I will give you a hint! It (aint) pretty!

Been there, done that. My audit lasted two weeks....Haz Mat 'specialist' and NO Haz Mat violations found...plus I understood the requirements of 172.702 and made sure the necessary permission from the Haz mat employer [my boss] authorizing me to determine the materials used to meed the training requirements of 172.704...it helps to pay attention at PHMSA seminars...

When the FMCSA begins an Audit they will start by examining the Data collected by the states. They will also assemble a team of auditors that know this carrier and their business model forward and backward. They will put together a "hitlist" based on this. If the carrier has an abnormal amount of equipment OOS based on one thing they will hit the shop and audit. These auditors will hit the carrier safety dept and check the drivers on their "hitlist" HOS records, they will also start looking into the driver qualification files. If they find a "problem" driver was allowed on the road through a slipshot hiring process that just pencil whips 391.23 the FMCSA is going to issue a fine to that carrier and place them on watched status. One of my old carriers back in Georgia went through this process in the early 90s. They almost got shut down.
Yes, if a carrier hauls a lot of hazmat the FMCSA will be checking the records.
From start to finish, from the time the auditors start looking at the data, go through the actual audit then the followups this process can take up to a year, longer if the carrier is put on the watch list.
The three things the FMCSA will not tolerate are a history of running faulty and unsafe equipment, Allowing drivers to routinely violate 395 and ANY carrier or company that pencil whips 391. -
I got a message asking to call back.
They asked what type of information I was requesting and I told them everything under my name and social security number.
They asked if I was a truck driver and I said I thought so, at least for the last 44 yrs or so.
Was told I was not in their database and had nothing to send me.
Hope this won't prevent me from seeking alternative employment shall I choose to before retirement...lol
All the talk here on DAC reports had me wondering about mine but alas...COBB2070 Thanks this.
