The company where the damage occurred, is where the claim is made. The broker doesn't have a thing to do with it, it is their liability insurance that pays the claim or the company itself. This is in all 50 states.
In Michigan, if the shipper or receiver people tell you to park in a specific dock, they assume all liabilities for the damage, even if the truck or trailer is hit by another. I have been in court with this a few times, the last time was with gm where one of my trucks was hit hard by one of the auto supplier's trucks, and ripped the hood off the truck.
