It's my ((((opinion)))) that the FMCSA has decided to waffle on holding shippers and finals responsible for this detention since they are so tight on the HOS. They do have the authority granted to them through the interstate commerce clause of the US Constitution. PC is not really codified in law or a rule. It is something that the FMCSA allows through their statutory authority granted to them in title 49 USC. <<<yes I said 49USC NOT 49CFR! Look, I am retired and because of seizures can't even drive a car! I no longer have a dog in this debate. I just don't think it is right to hang drivers up like this!
