If the driver holds a CDL "A" or "B" and fails the drug test this requires the driver to be immediately removed from performing safety-sensitive functions (i.e., driving CMVs) until successful completion of the return-to-duty process with a DOT-qualified substance abuse professional.

If the driver is not removed, then the company is subject to heavy fines. The driver has to report to the new company the failed test, if they do not the FMCSA can levy heavy fines if they hire them.

 

I'm glad it must be reported.This industry has no room for anyone doing anything illegal.I have zero compassion for the ones that think they're above the law and do as they please.I'm simpy saying the op wouldn't pass any drug test.

 

I can't believe Pepsi doesn't also do hair follicle testing, plus Pepsi has a pretty strenuous road test because of things that happened years ago, they don't really screw around at Pepsi.

I don't think he can do the SAP program. He wasn't an employee yet; he failed their prehire drug test, so he's probably not protected.

I think a lot of people misunderstand what DAC is. ANY company ANYWHERE that has access to the internet can buy a DAC report. All they have to do is go get it. Does Pepsi generally use them? I say no they don't, but you can't just say never because these reports are available if though to be needed.
