    USA Employment is at will when is. Either may stop at will. There is no contract usually.

    I am beginning to lean towards maybe we need to scrap that kind of problem, it makes employees too disposible and employers unable to feel that they can count on anyone.

    well given that we do not know if the o/p went to CDL school at Schenier, there may, or may not be any contract. Schneider is not a union shop, so yes, "at will state" may apply here, again, unless he was under some sort of employment training with them..



    maybe so, but also too, private carriers do work/operate in "at will states" , making collecting anything but the weekly pay due, next to impossible.

    this is why i have said over and over, I DO NOT give any notice, the company will notice, in 2 weeks, that i am not there"....

    i never left any company without collecting any time off, such as a paid vacation(s)...i made sure i took them, even up to the point of "hanging in there", until i could take that vacation, meaning, waiting my turn to do so.

    nearly every company i ever worked for, REQUIRED notice of when i wanted to take my vacations..

    that (in most instances) was at least 1 months notice, i wanted that time of.

    one union shop i worked for, in january, is when they'd have us go into the office by seniority mind you, to select our vacation weeks...

    top guys like i was, had an open calendar, where the lower guys had to sit and wait till we senior guys got to pick and choose.

    frankly, i cannot see how he got workmans' comp, just driving to work, not on the clock....if at best, what is known here as TDI..temporary disability insurance, when when get's hurt off company property, like at home...

    i cannot fathom how workman's comp was involved in his situation, going to work...not even on thew clock, or not even driving a company vehicle....like he may be allowed to take the company rig home.

    but then again, each state has thier own laws regarding many things.

    it like credit cards and the interest rates....

    your state (if they issued you) a credit card thru YOUR bank, may charge say 12% interest...

    but if you apply to a credit card company, say in NY and their rates are 27%...say hello to 27%...it's from the state of issuance....not your home state, no matter how low your state banks charge..

    The exceptions that exist include:

    • When the employer provides the employee with transportation to and from the place of work and the employee is injured while in transport.
    • When the employee is travelling between two locations on the work premises.
    • When the employee performs part of their work at home and an injury occurs between the place of employment and the employee’s home.
    He was under dispatch and they paid him per diem per mile between his house in Kingman , Az to Topoc Az for gas and travel . I assume it may have fell under the third

    I’m sure you helped some others with your advice sorry you didn’t know in advance it’s good to ask around b4 giving a notice There are some companies that will not take a notice they will just terminate employment at that time,hopefully you can at least get all or some of vacation time
