No driver shall perform safety-sensitive functions within four hours after using alcohol. No employer having actual knowledge that a driver has used alcohol within four hours shall permit a driver to perform or continue to perform safety-sensitive functions.
§ 382.201 Alcohol concentration.
No driver shall report for duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater. No employer having knowledge that a driver has an alcohol concentration of 0.04 or greater shall permit the driver to perform or continue to perform safety-sensitive functions.
According to Appendix G of part 40 if you blow more than 0.02 you have a problem.
Generally speaking, the average-weight adult can metabolize ONE "shot" or beer in one hour!
DO NOT submit to a DOT alcohol test after going ON DUTY if you think you will "blow" more than that 0.04! EVEN if it cost you the job call safety and tell them you have been drinking and can't test. As long as you are NOT on duty this is NOT a refusal to test. It is ON YOU to make sure you are fit for duty after time off.brian991219, ZVar and Mototom Thank this. -

They run a lottery with a place the next town over who uses a PC program to randomly select us every so many months.
Tbh I usually just get told "I need you to go piss in a cup sometime this week" but I've been working a weird schedule.
(Probably not legal but I don't do drugs so who gives a ####)
Today is my Monday (tho it's gonna be a short week) -
Is there a time frame on when a employer can tell you you need to be tested. I had one tell me on Tuesday that I needed to be tested next Monday. I don't drink at all or do any drugs so no big deal they just try to fit it into the schedule.
