DOT FINES

    My company was audited today..we run verrrrry long hours and have done so for some time now.can I receive fines along with the company?

    When the auditor found our false logs, she asked for the home address and telephone numbers of those found falsifying. It put the fear of god and the DOT in those guys.

    The DOT never called them or fined them. The auditor told me that they would check to see if the guys were forced to falsify or did it just to try and make more money.

    I guess the $17,000.00 they fined the company was enough. The owner was upset as he was gonna use that money on a pleasure boat that spring.

    I do know that the fine is immediate and is usually just the company paying it, since they have deep pockets and DOT messing with individual drivers who usually have nothing anyway would take too much effort.

    ok i had a adit last year i was told i only had to keep logs for six months but said most keep them two years but if anyone was invoved in a wreck it could take years to go too court and would have to have them

    Especially if it's there and there is no evidence that the driver was ever brought in to discuss the matter with safety.

    Today, I went in to talk with our safety director regarding my red light citation. I watched a couple of videos and signed a letter written by safety stating that my citation was discussed, I was verbally warned and that I would pay the fine on the ticket. He said the letter was for this very thing, in case the DOT does an audit and checks that I did receive a citation and that I followed the requirement to report it and the situation was handled.

    Fined & Sentenced for falsifying log books, stemming from a fatality accident? Where's the manslaughter, vehicular homicide charges? You kill someone because of your negligence or reckless disregard you should be setting in prison for a long, long time!!

    Some of the penalties were to drivers found violating through the audit . This only show charges pressed by the DOT . The charges you ask about would be filed by local or state police .

    One common thread I see in every post about DOT fines or some type of action taken by them.
    1 is there always seem to be two sets of records
    2 they always do it in groups.
    I would think if you're going to this much trouble buy a papper
    shredder and do it by yourself?
    I see a pattern here they go after people who really don't know how to handle situations like this.
    The big megacarriers are left alone other than maybe a contribution here and there.

    Only keep the logs for 6 months. If an accident happens, keep those only for longer period. Give them nothing to look at.

    A friend was got hit in the rear end in Oklahoma. I was running with him at the time. The company kept his logs, but not mine. The attornies contacted me as part of the deal and wanted my copies of my logs. I told them I only had to keep them for 7 days.
