I have a DOT safety audit next week but my company is out of business and I have revoked my authority. Do I still need to go to the safety audit?

Send then the info. They will need records of how you kept logs an insp. records, driver file with all pages in it, so you have time to gather all papers you can ask for a later date to send all info. to them

Personally, I'd be inclined NOT to do it. Company is defunct. Authority already inactivate. What are they going to do? Unless you plan on reactivating your authority or seeking your own authority again at some future point in time, there really isn't a whole heck of a lot you would think they can do...but if you plan on telling them to buzz off, I'd still recommend consulting an attorney first to find out what your obligations as a FORMER carrier have to the FMCSA and their audits.

Yes. Its a State Agency, they'll audit the past work performed. Recall, you do not want to receive a fine and/or Court Appearance.truckreeferman Thanks this.

If they still want me to go in i will, i just feel like it'll be a waste of time because like Bulldog said what can they do to me im already closed lol. Also this is a safety audit not a compliance audit which are alot stricter

You do not have to attend a safety audit if you do not plan of activating the company again. Just call the folks and let them know that the audit is no longer needed.

If you received an audit notice from the IRS on your closed business, would you ignore that? I think not.
Just because your business is no longer active, doesn't mean the DOT can't perform a safety audit on past performance.
In addition, you are required to keep records on file for three years in most jurisdictions for IRP & IFTA review, even if you close the business. If they deem you under reported, they can go after you for what's owed, even after you have revoked your authority.
