FMCSA found that BM&L’s owner created a new carrier, as MTI had the same business location, phone number, drivers, officers, vehicles, customers and insurance as BM&L. “The practice of unsafe companies quickly reincarnating as chameleon companies to continue operations is unacceptable,” FMCSA Administrator Anne Ferro said in a statement, adding that the agency “is constantly doing everything . . . to keep one step ahead of these illegal actors
When going thru A Safety Audit: The Carrier will identify whom they are. The Auditor will have the ability to preform a comprehensive exam over All Business Records. Typically, they will be focused and ask specific questions. To keep it simple. What if, your Carrier was closed down 2 mos prior...meaning you dont attend the audit today, because you dont want to be found out, that you violate an order to cease operations.

The FMCSA can't order a company that is no longer in business to stop doing business. They can't issue fines to entities which no longer exist. Rather than wasting time and resources going after defunct companies, they should be focusing on companies that are still actively doing business.

Devil in the details: Base Plate, paid for in advance one year. IRS Form 2290 good for a year & paid for in advance. IFTA, annual permit. BOC-3 filing paid for in advance, Carrier Insurance, Truck insurance, Trailer & Cargo Insurance,
DBA Business License, (curious if this was canceled.)
(Common Carrier License was this license suspended by the applicant if so, why would there be a need informing the State Agent. Whereas the State would of been informed.)
Oh for the erudites, Business Entities are assigned IRS (W-9), EIN numbers. When closing your business account did you notify the IRS in writing: (myself, im thinking this didnt happen either)

Personally since the information promoted by commenters has been so poor im believing the closure of the Business was more done by happen stance...verbally stated...i've closed more doors ergo im out of business. HUMPH! im thinking the business entity still exists on paper ergo Audit then make interpretations...
