Dot violation attributed to Motor Carrier

    Need to know if anyone has received this type of violation on a level 3. I'm in NY state and was pulled in. Officer said it did not go against me, the driver, but against my company. The truck did not have a NY HUT sticker or a permit assigned to it. The licensing department at my company quickly bought one and emailed me a copy to show the officer. But he said they just bought it 2 minutes ago and it was too late. So a violation says "attributed to motor carrier", I just want to be sure this doesn't hurt me. He said it didn't. Violation code TAX 1815A1 section 392.2

    Anything a dot officer says is a lie. That said iirc its not a federal thing so it shouldnt hit you. But your company is about to get slapped for a 2k fine.

    I’ve gotten two Oregon weight-mile tax tickets in the last month thanks to my company. The lady at the companies fleet office lied to my boss when he called to ensure the new truck was Oregon compliant. I’ve never seen someone outside of the military make someone cry over the phone.
    I’m sure I’m going to have to take all the tests next time I renew my license because they all counted towards my record. the only good thing is the company is out $5000ish dollars because they couldn’t fill out a simple form.

    Thats only fuel tax BS. Has nothing to do with the driver.. wont go against your license and shouldnt go on your psp score either

    This NY HUT violations should not show up on the driver's PSP record, so there is nothing for them to worry about. If it does, then file a DataQ challenge with a copy of the inspection report and proof that the motor carrier corrected the violation.

    New York motor carrier enforcement is known for getting their information reported incorrectly, so if I were the OP, I would wait about 60 days then order a PSP report from FMCSA to make sure the violation is not on my record.

    Good advise.

    I had to Data Q to get a turkey flying into the windshield removed as a recordable accident.

    I did make them laugh asking if a turkey's suicide by windshield was recordable...they removed it!

    HUT is a third tier tax collected by the state and has managed to out last over 40 years of court battles.

    NY won the last round by making the decal cost reflect only production cost and obtaining a decal not a revenue source.

    TIP: the empty weight method is the cheapest way to go!
