No one has seen a disqualifying threshold... the FMCSA/DOT/LaHoodJerk haven't figured out where its at.
But you're right Injun... I saw that myself. And... saw an article on OOIDAs LandLine website around a month ago indicating that this disqualification of drivers is part of the administration's "wish list" for things to be included in the next highway authorization bill.
I always figured that it was just a matter of time once FMCSA started collecting safety statistics on us via the PSP...

Uhm no, the driver is responsible. You are required to do the daily inspections. You are required to make the call to drive the vehicle. You answer for subpar equipment when inspected.
An owner can only fix what they are told about by the driver doing their job.Now if a driver reports it and the owner refuses to fix it, the driver can refuse to drive it!So we are right back to it is the drivers responsibility.aussiejosh Thanks this. -
I wouldn't drive here either, but not because of this. If a driver reports an issue it will be corrected. If you aren't doing a pre trip you really have no business being on the road.LaBubba Thanks this.

And when the driver refuses to drive subpar equipment, the unscrupulous owner will fire you and find another sucker to drive his junk!
Hell, I had a problem with a bad steer tire at Knight Refrigerated, they refused to replace it. It wasn't until I threatened to take it to a scalehouse and let the officers have a look at it that the company decided to replace the tire and fix the underlying problem. Drivers can't even do that anymore because of CSA 2010. DRIVERS will still get the violation on our record even when we turn ourselves in because some fleabag company won't keep their junk maintained! -
Don't drive it. It is that simple.
Your example would require you drive the deficient vehicle to the scale. That puts you in the wrong so you should get a ticket.
If you find an OOS worthy problem don't move the vehicle until it is fixed.
But yes your right they can find another fool to drive it. That is why the driver and the company are held responsible. Drivers better figure out it is their behind on the line, and start growing a backbone when dealing with anyone.
The truck is broken and will not be moved until fixed!

Unless your carrier is excepted as provided for by (d), above, telling you to not fill out the daily vehicle inspection report is like telling you to not fill out your driver's log. If you have proof of them telling you so (which I doubt) then you do have legal recourse... especially if you are fired for complying with 396.11. However, if you follow such a demand and you get inspected, you are going to get a ticket... plus 4 CSA points (multiplied by 3 in the first year and 2 in the second year).
