I never did reference 391. If you would have checked my link it would have brought you right to 383. I've been reading government regulations since I was 17 and it just appears stupid to me to list two different requirements saying basically the same thing. But that's the government for ya. So which one are we to follow? The one that says list all employement history for 10 years or the one that says 3 years unless you were driving a truck. Because if you read them carefully, which I have, I believe it would be safe just to list 10 years and let the company do what they want to.

If you wish to list 10-years that is permissible however the 391 rule takes presidence as that is the specific requirement(s) for an application. Part 383 has nothing to do with an application. Why it remains is unclear however it is not the applicable rule in this instance.
P.S. In order for me to read rules properly the USDOT sent us to a training class taught by an attorney. It also included a class on torts, and interpretation -
So, the employer will have all of this work and experience history as required by the regulations. Perhaps subconsciously, the employer will read between the lines and form opinions. Is the applicant a job hopper? Does the applicant have trouble with supervisors? Does the applicant work well with a diverse group of employees? Do the reasons for leaving employment sound reasonable? Will the applicant be loyal to the company through various seasonal and economic downturns?
One interviewer noticed that I had been with a previous employer for thirteen years. They are always looking for "company men". -
No person can establish what an individual carrier reads, or doesn't read between the lines except that motor carrier. -
I was told in school 10 years for driving jobs if you havent been in a job that follows dot rules like burger king then its only 3 years

I realize this is an old thread but to this day I am still arguing with employers who misinterpret the regulation about work history. As I understand it, it is still just as psanderson posted Sec 391, when filling out an application for a DOT driving position, you are only required to give a full history, including non-DOT jobs and gaps, for the past THREE years, and then any DOT driving jobs for the preceding SEVEN years. Meaning that ONLY driving jobs need to be listed in that 7 year period, no need to list any non-DOT, gaps, etc. Am I not reading this correctly?? It seems pretty cut and dry to me. If they wanted a full 10 year history then why even mention anything about 3 year history?

Even if it is true, and I don't care enough to verify, it doesn't matter. What DOT requires is only the minimum of what's needed. A company can require the past 50 year work history and there is nothing immigrant about it.88 Alpha Thanks this.
