If a DOT cop pulls my personal car over, 23 miles away from the nearest interstate, then I bet I was doing something way worse. We don't have DOT cops where I live, let alone county or state troopers. Besides I thought DOT cops concentrate on commercial vehicles. And if I know I'm right, with the facts to back it up, of course I'll argue. I do it all the time. Bureaucracy can be used on both sides. Anyway we got the answer, after sifting out the opinions I didn't ask for. .04 truck, .08 4-wheel, regardless of license type in Illinois.
they do concentrate on cmv........dont give the keyboard cowboys a chance to badmouth unless you can take it
It is not a matter of DOT cops getting you. A city cop or sheriffs deputy can get you and it would be up to the prosecutor what they want to do. If I remember right in MO the prosecutor does not have a choice to plead anything down or changing anything when it comes to CDL's. Now the Judge on the other hand probably has the power to impose points or what have you if they choose to.
I'm not a advocate for drinking and driving but I am an advocate for giving correct information and backing it up with some links to the law. This question has been knocked around here a few times and there's always some answers that are basically are off the top of the head. Every time someone says it's .04 in a certain state I look up the law and every time so far it's ALWAYS said while operating a CMV. So if you're going to quote a law give us a link PLEASE.
GasHauler, Were you speaking to the forum in general or are you asking me for links to each of the state laws that I cited in my previous post?
I'm sure he didn't mean you. You did a great job on your post. And thank your for the time it took you.
Wow, all over the block on this topic. I would encourage the OP to just stop drinking. If it is not important then what is the point? My license is important. Too important to lose to a Sobiety Check and blowing into a straw. I'm not intending to sound like I'm making a judgement. I'm not. I'm just promoting a solution that works. What you do is what you do.
All I'm saying is this board is very informative to new drivers and I believe we owe it to them to pass information that is correct and backed with links when the laws are quoted. Yes I was speaking to the forum in general. By no means do I want to step on toes here but again I do believe it's very important to give the correct information. I have yet to see any state laws that say the BAC is .04 in your own car. If I see a reference and not just someone telling a friend or it happened to them but a law then I will be the first to say I stand corrected for that state. The same goes for a medical card. There's been people say that we must have a current medical card when we hold a CDL and drive any vehicle. Now I have seen some states that do require this but not all of them. There's are some of us that are retired and want to hold onto our CDL and not spend alot of money to have the medical card. So it's important to quote the correct information. Sorry if you took it as an attack I don't want that at all.
I agree completly, only difference is I have a 24 hour rule. This day in age if you get a dui, you are in an idiot, because it is so easy not to, it just requires a little bit of disapline and self control.
