I KNOW this by second hand, If your in your PRIVATE vehicle it's .08 !!!! ONLY if your in a COMMERCIAL vehicle, then it's .04. My close friend just went through this and I posted it before.

Just my $.02 and what I do and how I justify it. 1) we all have CDL's so aren't home often so if we own a personal vehicle it isn't driven much and after sitting awhile it's tough on the motor. So, what I do when I'm home is if friends want to go out the rules are (A) we take my F250 super crew because we can go to bar or up to camp w/o worry. (B) I'll pay for fuel for reasonable distances (around town, up to camp, camping in tents in the woods) (C) I'm not driving but will be rising shotgun because it's my vehicle and I want leg room and don't want to drive having more then likely driven around 11,000 miles in the last 30 days.
Everyone is happy because your paying fuel, they don't need to worry about where their car ends up at the end of the night, and you CAN STOP CARING about wether or not there is a difference in DUI/OUI laws for CDL holders in your area. For our 1 unfortunate friend in my group that doesn't posses a CDL that means he is DD that night unless one of us has stuff to do in the AM and is NOT drinking at all.
With no links, arguing, or claims of vagueness I can assure you all this method is 100% legal in all states and provinces in US & Canada and legal in 100% of all countries where alcohol can be consumed or possesses. In fairness and full disclosure I personally only have experience doing this in US and CanadaLaBubba Thanks this. -
So it looks as though I was incorrect or the laws have changed. I left the department in early 2004 so either may be the reason. I have defiantly been wrong before.

If people have to ask if it's OK to drink and drive...then you have no common sense. One beer...two...six...being a former alcoholic, knowing your limits does not justify getting behind the wheel of any car or CMV period...it's not just YOUR livilyhood...it's everyone's LIVES around you when you drive impaired.
I also have a CCW permit...and in Nebraska, it's a ZERO tollenance when it comes to carrying and drinking. Let along being illegal to carry in places that sells alcohol. Anymore I don't even drink at the family gatherings.
In just my honest opinion, and the only one I push on others...don't be stupid...either drink and don't drive, or drive and don't drink...simple as that.LaBubba Thanks this. -
Best thing is don't drink if you plan on driving I would just wait until you got home.

Every state CCW is different...that's why some states don't honor other state's CCW
