If you get drunk in your house and have the keys on the kitchen table it's highly unlikely you'll be starting up your house and swerving down the road. Unless your house is a vehicle, then you'd be in control of the vehicle.

Simple DMV ####e for 4 wheelers- don't be drunk in your car with your keys.

That's on the test for teens to drive cars.

I'm okay with that law. If you are drinking, make sure you have a safe place to crash. If you don't, don't get wasted. If you can't help but get wasted and have no place to sleep, sleep under your car.

If you're homeless and live in your car and drink a lot, buy a jack. Jack the car up before you pass out in your piss and vomit at night. Cops are not going to charge you if the car is disabled.

A car is a safe place. Way safer than passing out on the sidewalk. Not much different than taking a nap in your car in a rest area because you're too drowsy to drive safely.

Not true in Texas... Last year a Denton TX resident was on the news for his 3rd DWI-which occurred in his own driveway, in a vehicle that did not currently have a motor. He was just drunk and working on the interior lol.

I had a friend convicted of something similar. Pulled over on her way home from a bar to puke. Cops found her asleep in the driver seat with the engine running, high beams on, and her foot on the brake.

Sounds like something even a rookie lawyer should have been able to beat.

I think that would be up to the companies.if this happened recently good luck finding an employer that will hire you.If this was some time ago again good luck. Those words under the influence tends to scare companies.

Every authority responsible for this should be put in front of a firing squad.

Texas only requires an intent to operate, which is why they can charge you in your own driveway. They ended up dropping it down to Public Intox. Texas is getting real strict on drinking these days, they issue PI's inside bars now lol.

That's the way I'm reading it. I think it's ridiculous, if the guy is not driving what is the problem? All this, "but he could, or he might" crap is ridiculous. I might get drunk, take a cab home, get hungry and then drive my pickup. Someone sleeping in a car drunk should be celebrated, not criminalized.
