Good buddy of mine up north during got a DUI sitting in his car during a blizzard in his apartment parking lot.
His exwife loved to argue ,he hates it , he had a good buzz when she layed into him so he went out to his car in the parking lot during a raging blizzard, with no intent to go anywhere.
Sitting in the car with it running because it was 0 degrees out listening to music.
A guy plowing the lot called the cops because of a suspicious car running.
Cops came to investigate after he been sitting in it for an hour waiting for exwife to go to bed,

I played high school football in the early 70s. After winning a big game most of the team went up into a place known in the community as a place to party and party we did. I was driving my moms car and left the party about 3AM drunk. I stopped about a mile later got out and threw up and got in the back seat and went to sleep. Just before daylight a State Trooper woke me by tapping on the glass with his flashlight. This Trooper knew my father and he did not charge me. However he told me to lock the car and he took me home. He would not leave till he saw me give mother her keys. I was on the highway right of way that morning and today I think it is considered a crime. I do hope the OP can overcome this and move on.

The bottom line is that no one can be near any vehicle whatsoever, whether it is a 4 wheeler or a CMV, if there is any alcohol whatsoever inside one's system. IT IS SIMPLY TOO RISKY!

Yes...The trick to beat the physical control charges is to NOT have the key in the ignition and sit in the backseat if possible.

I heard that the keys can not be in the vehicle period. Honestly the best thing to do is avoid being around any motor vehicles if you have been drinking.Doing_flatbed_nc Thanks this.

^ this. I mean unless you are in a super rural area, there's little reason to pass out in your car.
Pre-plan your drinking the same way you pre-plan your driving and you'll be fine every time -
I never cared if I won or lost a DUI case. If I lost look at all they lost could be more than a win. We had to represent the State ourselves vs. defense attorneys.

Yep part of our training was laws etc and courtroom procedure etc. Initial training was 6 months.
