Most of us are not so anal....
You're post is just fine, dispatchers lie alot, you should be fine in court just stating the facts and standing on truth !
Sounds like they are trying to pass the workman's comp bill to you for this " on the job injury", if they push it any further you could sue the heck out of them

    What were you hauling?
That is bad. I never delivered there. I usually did not have to wait mor.e than 15 min to get a dock, and they would pull off 5 - 9 pallets. They would have one dock open to use and the rest had trailers parked at the docks for storage...

I did deliver to a shoprite in philly and the receiver took a 45 minute break, and guys couldn't get their paperwork signed to get out of there while he was smoking and wondering around the store. All the drivers knew the guy, and knew he was a Jerkoff. All the other stores I went to in nj and ny were good folks to deal with.

Oh, there was one receiver that locked the dock door for a half hour when he went to lunch...I just went out the front door and walked around to my truck. I think he only delayed me about 5 minutes until his lunch break was over.

One place in philly was locked up so tight I had to go around to the front of the store to get into the dock.

I only got bumped once by a guy hauling milk. They give the milk guys priority over frozen food guys. Also, turkey haulers can bump everyone to get unloaded. I doubt they have room for more than one load of turkeys a day in their freezer.

So it depends on what you are hauling as to whether you get bumped.

I went for a year without working after I moved to PA, so I don't have enough wage credits to file for uc, otherwise I would. I am semi retired and only work part time, but depending on how my work comp hearing goes, I do have one more step to take against them.

If the work comp judge rules against me then legally my injury is considered not work related, and PA law allows me to file a civil rights complaint for discrimination due to a non work related injury, against the employer. No lawyer is needed for that investigation, as the state agency does that.
They will have a mediation meeting where I can lay out my legal plans to the employer and attempt to arrive at a cash settlement.
At that point I will be asking for a year of lost wages, and double the amount of my medical expenses, plus travel expenses to Harrisburg.

If the state finds probable cause, they will issue a letter allowing me to sue the employer....that's when I get an attorney and I sue for three years wages and double damages plus whatever else the attorney comes up with.

This is not a step the employer will want to go, so they may settle at the mediation meeting.....all depends on how the work comp judge rules.
