You'll need to be careful, maybe get an investigator involved before you tip him off. Without proof, he could assert that someone was stealing it from the truck without his knowledge. Could also claim major fuel leak, 24/7 idling, etc.

Nice and easy ask him to seat down, then ask him how hard it was for him to get his license when he got into the Truck Driving School. - Then ask him how hard it was to find a decent job, or a decent company or O/O for him to drive/WORK? - After he answer, just ask him to look straight into your eyes, then ask him "Why are you selling/steeling my fuel? Did you you that I can get you in jail and suspend your CDL license?"
Then you trow that Donald Trump's line "You're Fired".... After that, you can KILL him if you want (No, don't do that... hummm,.....WELL, go ahead kill him... lol) -

Why would he need proof? Michigan is an "at will" state.
Fire him immediately. You do not need to give him any reason at all.

I live in an "at will" state as well. Wasn't aware Michigan was one too. Still, the OP would be on higher ground, so to speak, and could feel better about firing him if he could prove it. Even though it may not be legally required to prove it to fire the thief.

I have been through this before and your best bet is to get the police involved. You should at least talk to the police. If you feel that you can prove the theft then I would prosecute him. There is too much of this type of theft. Remember, he probably stole money from eomeone before you and if you don't prosecute him, he will likely steal from the next guy. I wish we had a registry for drivers who steal. With a record, it will at least be a red flag for the next carrier or owner operator whom this guy applies. Stealing fuel is one of the most common thefts committed by drivers, but is one of the easiest to catch. If it were me, I would prosecute him and do whatever I could to see that he served hard time.

I still think it's possible something is wrong with the truck OR someone is stealing fuel from him. I mean if the only evidence is he's going through more fuel than he should be you really don't know.

Yikes! What about showing him his numbers,? It sounds like he has a gambling problem or a drug problem and if you don't get the Police involved and get him prosecuted and then get him thrown in jail, he will do this again! I'm going to tell you, that if he thinks he has you hooked, then he will continue to get worse, Has he taken any advances? That would tell you if he is using this fuel money to survive on. WOW! as Honest as I am I can't see doing that EVER! It doesn't matter that he may think the company is screwing him... This is unbelievable.
