Driver's responsibility or company responsibility?

    lol, if he lost them he pays, theft is different. but all this should have agreed upon at hire. why you think companies take out an escrow?? just for the heck of it, its to ay for your screw ups... back in the day it was common for company drivers to have as much as 1500 escrow.

    take it out of his pay, guranteed he will never lose em again.

    I'd say if you're going to implement a policy, you should never do it retroactively... "Oh by the way that was against our policy.... even though we never told you so..." If you're going to charge for lost load locks, you should say so first, before any load locks have yet been lost. Otherwise, just pay the first lost set yourself, and then let him know you'll charge for the next.

    Or you could split the difference between the two options: Pay for this set yourself, but tell him you'll dock him double if he loses another set (to pay for the first set).

    Employees are bound to pay for losses or damages if it is a signed agreement when hired .
    Also employers are not bound to employ drivers that have a habit of losing or damaging equipment .

    Changes in policy also require a signed agreement . Even though employers can't deduct from wages they can still terminate the driver and/or file a civil suit .

    If it were me, it would depend on a few things.

    How long has he been driving for me?
    Has he ever had a screw up before that cost me?
    Does he generally do a good job?

    If its the first time a mistake has been made, he's been with me a while and I'm overall pleased with his work...I'd let it slide THIS time. Next screw up is on him.
