Driving CMV without a CDL

    It was a ticket for 15 over but in VA 15 over is Reckless Driving and thats what it was reported as on my DAC. DAC told me they cannot remove reckless driving citations from my DAC Report. Ive been asked about that ever since when I leased to companies even though its no longer on my MVR

    That and the fact that their hitting the pickup truck drivers with the sleeper berth violation (unless they actually had one custom built for their truck).

    Didnt say it would. I said if. I didnt think a 15 over ticket would end up on there but it did?

    Reckless driving in VA is a class 1 misdemeanor not a mere citation. Like I said, it's haunting your criminal record not your DAC employment history. Go ahead and request your DAC from Hireright and I'll bet you it's not on your employment history but on the criminal records check.

    That's why Hireright said they can't remove it, because only a court expungement can.

    And Virginia has been exceptionally ruthless with truck drivers in recent months,and not just at the scale houses either. Along I-81,I-95 and I-85 they've been looking for excuses to cite drivers for speeding.
    Another thing to remember is that operating a CMV without a valid CDL is a violation covered under Section 383.23 (a)(2),under the "Driver Fitness" category. And IIRC usually the penalty for that is a lifetime disqualification

    Nothing to worry about. Many years ago I got a driving cmv without a cdl ticket with a similar setup. I was driving a Dodge 3500 dually pulling a 24ft tag trailer with skid steer and atv.

    I went and got my cdl learners permit. I faxed it to a lawyer in the county I got the ticket and he got it dropped.

    That was years ago. Nowadays,in some jurisdictions if you don't have the proper credentials at the time you get pulled over and you end up going to court for it and said credentials weren't in present or in effect,the court will enter it as a conviction on your license.

    Even misdemeanors drop off your record after 2 years, why is it on the DAC after 14 years? I get a copy of my DAC once a year, have been since 2003. I was looking at it when I made my comments. It doesnt matter what section its in on the DAC, fact is, its still there. Employers still see it when they pull a DAC on me.

    No overstep when the GVWR is used to determine type of license of any trailer used with a CMV.
