    Well, one thing they could do is since Goodwill owns the compactor, but the trash company hauls and empties it, is after they pull it find a nice big parking lot to go through it in.

    How about a duck with latent scavenger tendencies....?

    My preference is Dumpsters where folks are cleaning out an estate. I'm pretty selective, though, about what I take. :biggrin_255:

    Technically, they are. I would tell your company to stand their ground...I may just be a jailhouse lawyer, but any cop will tell you that once it's in the dumpster, it's no longer Goodwill's property. Their intent is clear when they throw it in the dumpster...they no longer intend to use those items and are discarding them.

    Theft is defined as depriving someone of the use or possession of their property. You cannot deprive someone of their property if they throw it away. By "dumpster diving", you lack the proper intent to deprive them of their property because their intent was clear when they threw it away in a recepticle clearly marked as "trash". I'd let them call the cops if they want...and if the cops are dumb enough to arrest you for it, take it to trial. I guarantee that the dumbest just-out-of-lawschool public pretender will get the case thrown out or a jury will find you not guilty.

    Cops and investigators use this little loophole to get evidence into a trial when criminals are dumb enough to throw incriminating stuff into the trash...which is why all the good criminals BURN anything connecting them.

    The thing we don't know here is whether the waste generator (Goodwill) has any agreement with the hauler that items disposed of in the dumpster must be destroyed (or in this case buried in a landfill)

    When I hauled Scrap metal there were a lot of companies that insisted whatever they threw in the container be destroyed. Some even wanted pictures. In fact we had one jet engine rebuilding facility that had us load the containers for them and that was only after I destroyed the parts piece by piece with a torch, while they took pictures and documented it.

    i worked at goodwill in high school sorting through stuff that people donated, basically a helper/mentor for the handicapped persons there.
    (if something is too dirty for you to put on before you donate it, dont donate it for gods sake, throw it away.)

    the reason theyd be threatening that is goodwill has ALOT of problems with theft. all the way up to internal embezzling scandals, major problems. anyway what theyre on about is, someone on the inside could be throwing away things theyre not sposed to be. trash collector (or any other informed person) gets the items, and just so happens to have a weekly yard sale, etc etc...

    i know thats not superrealistic, but i assure you it happens.

    Does anyone know if Central Transport local hourly work only pays 8hrs with no overtime on a 12 hour day? Or any other local company?

    ...Would toss all kinds of sticks, and occasionally hand files away,...bin was hundreds of pounds a day...
