So, driver and company penalized? Just makes me wonder why some push the driver to do so. I've heard " go over" use "off duty drive" to get things were they needed to be. This was in my first year before I knew there were real consequences. I thought of it more as a loophole then I guess. But if the company takes the hit too....odd. Do internal log departments play a role somehow?

The companies get audited by DOT so they have to be pretty strict. Safety at FFE years ago told me they randomly pick drivers to show DOT their logs and cross fingers that all is good.

I worked in government outsourcing for years as a younger man and upon audit time, we were always "audit ready". That was in an unrelated field but business is business. -
In the real world safe haven does apply. Been there done that non hazmat and Virginia dot agreed I was good. Before I moved an inch after my hours where up I had gotten company approval on my Qualcomm. When I was inspected and the red hos violation was blinking I was good to go further on the move.

There's a slightly different violation alpha-numeric code that DOT agents can put on the OOS which downgrades it from a regular/severe HOS non-compliance violation to a low level violation. The difference is like from 21 to 3 points on the CSA. That's if you're caught at a weigh station. I've no idea how this is handled through elogs. Does a company have to report itself to DOT? Or could they fudge the record by adding that .5 hr line 5 and simply warn the driver?

Now it sounds like you were already parked, but needed to move again to a "safer spot". -

The OP knew he did not trip plan accordingly and was caught 30 minutes past his 11 on his Logs. The OP should have notified their company via the QC (for the records) and then the company has the option to take whatever again they may deem. If this was a first time violation - depending on the company and their SafeStat score they may let the driver off with a warning or fire them. There have been drivers here on TTR that have gotten fired for a violation like this.
Now it nothing happens and the driver does not get audited by DOT within 8 days and his company does not get audited in the next six months then it all becomes a moot point and all records are gone.tlalokay Thanks this. -
Any time you have the last hour, park that thing. Trip planning is nice but... save a hour every time you run your 11. Just run 10. Find a place to park.
The way things are changing we all will have a 7 to 5 workday soon enough.
