As far as I know, a post accident screen for drugs and alcohol needs to be accomplished within 8 hours of the accident. Any law enforcement officer can give a field sobriety test if he has reasonable suspicion that there is a need for one, and then the results of the will usually be followed by the breathalyzer test, or a blood sample.
I believe it's a DOT regulation, but in any case our insurance carrier and company policy make the 8 hour rule come into play for any DOT reportable accident.
I did have an accident last year where someone else hit my truck, and because it did not meet the requirements of a DOT reportable accident, there was no post accident testing required. It happened on private property at low speed (at least I was moving slow!) and despite the damage to the truck and the need for towing, there was no call for testing, though I inquired about it immediately as I reported the accident.
As for being bathroom shy, what is required that you report for the testing, not that you go in a specific time frame. Once you are there, the clock for reporting time stops, and rarely does anyone care how long it takes you to fulfill the requirement.
And as for the theory that you "did it on your own time" it won't wash. What they are looking for is the use of drugs, not specifically if you are under the influence at that particular moment. Just the detectable traces of drugs in your system meets the requirements for a positive test. If it's detectable, then it's covered. When you did it or under what circumstances is irrelevant to the fact that you did it at all. This is a zero tolerance industry, and that's the standard that applies. Whether or not that policy is fair is probably fair game for another thread, but under current laws, that's how it stands.
