I'm right.
This was on the last job application I looked at:
I think other specifics can be found in Section 1785.20.5 of the Civil Code...

Why does this always turn into a marijuana should be legal thing. Even if it was legal, you still wouldn't be able to drive with it in your system. Insurance and the FMCSA will always keep it that way.
Just think about it. Alcohol is legal. Can you drive with it in your system above a legal limit? Nope. Morphine is legal if prescribed. Can you drive taking morphine with a prescription? Nope. Now everyone will say, "Well marijuana isn't as bad as those things." Will insurance or FMCSA care? Nope.
I'm not anti-marijuana in the least bit, far from it. Fact of the matter is you can't toke doing this job and you either have to accept that or find a different job. -
Agreed.
We get a lot of "self reporters" in our companies labor crews. They get clean or cheat to pass a pre-employment then self report drug use to avoid compliance testing. Pisses me off. But the great state of MN makes it illegal to fire them for it. Actually a single positive test cannot be used here for a reason of termination. Pisses me off even more. -
The standard 5 panel DOT urinalysis doesn't even test for alcohol. Breath and saliva testing is the only DOT accepted way to detect alcohol. And pre-employment testing isn't required.
The metabolite test they do for THC in no way detects a currently impaired driver. You can be stoned silly and pass a DOT drug test. A much better test for detecting THC impairment would be a saliva test administered post-accident, under reasonable suspicion, and randomly like alcohol testing. So not only can marijuana testing be treated just like alcohol testing, it would actually detect IMPAIRED drivers!
By the way, There is a metabolite test for Ethyl Glucuronide (EtG) that shows previous alcohol consumption, regardless of current impairment (sound familiar?). It's sometimes called the 80 hour test. And it would actually make more sense to replace Phencyclidine testing with Ethyl Glucuronide testing on the DOT 5 panel test. I mean, does anyone really still use PCP? LoL. Even if some do, it can't be nearly the problem that alcohol is.
So alcohol vs marijuana is a two way street. There is really no good reason anyone should be driving a truck if they ever drink alcohol. All we need is for Congress to pass a law and we can test for previous alcohol consumption...-MadMax- Thanks this. -
So am I.
You left a little bit of important information out there on your other posts. Your reference states"Access to confidential or proprietary information" That includes a lot of companies including all of the gasoline companies since their additive blend is so secret. The word proprietary is used a lot in courts.
