Drug Testing

    I believe that once they develop a test that can determine if you are currently under the influence, legalization will quickly follow. I think that because law enforcement cannot definitively prove whether or not a user is currently under the influence or just used recently it is too difficult to legalize.

    Legalizing will not make it lawful to use while driving a CMV.

    Regardless of legality and prescription status, there are medications you are not allowed to be on and drive a CMV. Narcotics are not the only ones. In our industry, legalization would make no difference. We would still have to pass a wizz quiz.

    They are working on a breathalizer/saliva test to check for the 5 illegal drugs. If they can perfect it and pot was legalized without restriction, then maybe you could get high on your hometime. If its removed from schedule 1, I dont see why it wouldnt be enforced similar to alcohol.

    I guess the thread is a goner now. lol

    Mouth swab testing is fairly common outside the transportation industry. It's not a saliva test. It's epethelial cells from the inside of your cheek. Many industries have been doing this for ten or more years. As usual, because of the interference by the federal guv'mint, the transportation industry is behind the times.

    Interesting, didnt know that. So basically it checks for more recent usage as opposed to long term or long ago usage?

    The mouth swab currently does not identify if you are currently under the influence of marijuana, just that it is in your system. I see no problem with regulating marijuana use like we do alcohol; don't use it and drive, save it for your home time.

    Correct. THC is stored in fat cells. While there is a possibility epethelial cells would have metabolites of THC in them from previous heavy, long-term use, the testing is more accurate and will show a more clear picture of what you did last weekend or last night rather than last year.

    The reason we do not use this test now is the way the FMCSR is written, as our good friend Canterbury pointed out. We are behind the times due to politics getting in the way of efficiency. Typical.

    JB Hunt does or use to do the hair test. Usually 10% of orientation.

    What companies currently use the hair folicle test, and which use the urine? Also, what are some of the successful methods to beat either test?

    True; we are also behind the times due to religious dogma getting in the way of efficiency.
