    It’s legal, there are no regs, even state regs that define what is a hood and what isn’t. As stupid as it looks, and it sure looks stupid, it still serves a purpose, keeping debris and chemicals away from the windshield.

    While I am no expert on the regs, I have to agree with posts like this. I just don't see that there is any relevant violation.

    I would guess 392.9(a)(2) is what they hit the driver with if anyone cares. It looks like the right fender is completely broken off or is soon to be.

    I zoomed in on the photo, looks like the passenger side headlight assembly was damaged as well and as such was probably inoperative/defective.
    Remember that discussion we get about brakes,LIGHTS and tires(the three simplest things DOT loves to write up drivers for)? Especially during Roadcheck Week!

    I don't see how...

    §392.9 Inspection of cargo, cargo securement devices and systems.
    (a) General. A driver may not operate a commercial motor vehicle and a motor carrier may not require or permit a driver to operate a commercial motor vehicle unless—
    (2) The commercial motor vehicle's tailgate, tailboard, doors, tarpaulins, spare tire and other equipment used in its operation, and the means of fastening the commercial motor vehicle's cargo, are secured; and

    Here is the CVSA wording for OOS in regards to 292.9
    General Securement
    Part(s) of a vehicle or condition of loading such that the spare tire or any part of the load, cargo or dunnage can fall onto the roadway. (Vehicle Components/Dunnage - 392.9(a)(2) or General Cargo - 393.100(b))

    Note the "and other equipment used in its operation" section?

    That is where you get a "Failing to secure vehicle equipment" ticket from.

    Looking at online sources it appears 393.203(c) also applied but maybe the DOT inspectors I have run into just knew used the 392.9(a)(2) cite because it is used more.

    It is pretty obvious that the working load limit of the duct tape wasnt visible! And probably was exceeded. Any flatbedder can see that!

    Honestly, as a quick fix to take her home: for all the cost and time saved it is not as dumb as it looks.
    Safety wise the hood must hold together though.
