Due Process & CSA2010?????

My point was by the time you get around to having your "day in court", to demand your right to DUE PROCESS, it will be too late! YOU WILL ALREADY SUFFERED ALL THOSE LOSSES! Even if you win the court case (which you wont! But if you do) you wont regain all that you lost.

 

But, how is it different then rest of the world? You make it out like the system is just picking on truck drivers.

Because we shouldn't be setting up more systems that require you to lose out economically just because there's some altruistic way to say "See, I was right" in court.

Maybe if we devised a system where the absolute worst didn't have to happen to correct mistakes we'd have a system where smaller mistakes were corrected?

We should not have to live in fear for things we cannot change. We should be able to argue our grievances in court when they're presented and then be judged on their merits. Not guilty until proven innocent.

Example: If smoking cigarettes were outlawed, would you be comfortable with the government going back and fining you retroactively for every cigarette smoked in the last three years on a sliding scale of cost?

No. Not just no. HELL NO.

And anyone who wants that truly wants to live in a nanny state.

 

That is how our legal system works, has been that way from day 1. So far, it the best legal system in world.

This would not have happened if driver followed the rules in the first place, this was brought on by the companies and drivers greed.

Good or Bad, it is your work record!!!!!!!!!!!!You did it to yourself, no one put a gun to your head and said violate the law.

Hit the nail right in the head! We are SUPPOSED to be innocent till proven guilty.
This new system of enforcement and the recording of ACCUSATIONS which are beimg counted as CONVICTIONS is an insult to the most basic fundamental premise of our legal system.

They are getting away with this travesty because it wont be any governmental authority that metes out a punishment or deprives a citizen of his rights, They have strong armed private industry to do the dirty work for them, thereby circumventing the entire United States Constitution!
Regardless of who does it, the end result will be undeniable. You will have lost your job and your eligibility to get another job in this industry. BECAUSE YOU WERE ACCUSED OF WRONGDOING, you will suffer all kinds of financial and emotional stress. You can lose everything without ever stepping foot in a courtroom, without ever seeing a judge or jury.
What is really F'ed up is there are DRIVERS that think this is OK and welcome the systematic destruction of our rights!

 

Truckerdave, I wrote a reply to you a few pages back that in a nondirect sort of way adressed this.. It's the best I could do really for the fear of being banned is to great here, and because I can agree that it's kinda useless to single out one member at a time for a bashing, although I do find it awfully entertaining..

And because it seems more everyday that we are the minority, in here at least, you can take great comfort in knowing this.. The fools that are supporting this latest plague being cast down by the government upon truckers, called csa2010, will be the end of many of the same self-proclaimed truckers who are now praising it as the second-cumming..

By carefully examining the manner in which alot of these guys are posting, I have come to the conclusion that there back is to front if you know what I mean.. But here again, the fear of being banned is always looming..
Just think of it in terms of back when you were a little kid and didn't know any better, how simple it was just doing what you were told instead of having your own choices.. Luckily for me my parents had the foresight to look ahead, and probably didn't want the aggravation of still trying to raise me when I was 35, so I grew out of this mindstate of depending on others to think for me at the ripe old age age of 7..

But alot of these guys here weren't that lucky.. They actually take comfort in all this.. You see, since all the cyber-trucker types have invaded this buisness, more marbles can be had in the ways of the old-school truckers now more than ever, if you know how to play the game that is.. But the ones with the brown-noses and the least marbles will never be able to understand it.. They will always reject the mere thought of this game instantly.. Never will they be able to take a chance on their own judgement.. For the fear of screwing something up for the neutered is too great, therefore it is comforting for them to have everything regulated right down to when they must sleep..

It is truly disturbing for all the rest of us, small as our numbers may be, but in knowing that they are so naive and have such a false sense of security, that they can come in here and support the tactics of their enemy, just makes me sick..

So don't feel alone truckerdave, there are still some of us that feel your pain, but the numbers are definately not in our favor anymore, because for everyone of them you get rid of ten more will surely show up to protest at his funeral thanks to driver-mills = companies with their own nut harvesters..

So we might as well just sit back and take it easy for awhile, because it's pretty obvious that most of these, lets just go ahead and say all the unknowing supportive types in general, they're in front of the line and will fall victim the fastest to what they can't see..
Because everybody knows that truckin is a fair game right, haha..
