Actually it was a lady and eventually the Texas Supreme Court dismissed the judgment .

Doesnt matter, that they dismissed it. the point is fact they got it to stick and werner spent years appealing it all the way to the supreme court of tx is the issue. Most drivers arent going to have the cash to fight that far. Especially after a major wreck when their income is likely shot.

Keep in mind the wreck happened in 2014ish iirc and took till last year.

It actually does matter, everyone knew the lawsuit was BS,which is why Werner fought it all the way to the Texas Supreme Court in the first place. Even the police who investigated the accident knew that lady, who died in the wreck was ultimately responsible from the start. And since this was a final determination/ruling from the state supreme court that lady’s estate will be walking away empty handed.
If anything Werner could countersue her estate for damages incurred.
In this case however,Indiana tends to use a little more common sense. And since this involved numerous complaints and inevitably a DUI/OWI(for which the state police went through the trouble of getting a blood draw),even the ambulance chasers know that some cases are lost causes. The lady involved in this accident might be able to get a lawyer, but only one that might be trying to keep her from going to prison-good luck with that!
