I had one around 20 years or so which I had a CDL at the time.
My first court date was before the 30 day suspension date. Cop didn't show up. My lawyer told me yo say the officer never gave me a choice to blow or refuse. That he just said I had to blow into the breathalyzer. Even though he did give me a choice and explained it.
Since the cop wasn't there to defend himself they had to take my word for it. Prosecutor was mad asked the judge to supeana the cop for another day to defend himself and the judge wouldn't grant it.
So because of that my suspension was thrown out and I got my license back. I then got supervision for my BAC being over the legal limit (.114).
This was a long time ago though. I believe the penalties are more harsh nowadays.
Whatever the case, get a good DUI attorney. Especially one that specializes in the area. They usually know the judges.
My case was figured out in the backroom before court started between my attorney and the judge.
I was told what the judge was gonna ask and what my answers will be.
