Ok, I don't want to sound like a jail-house lawyer here. BUT, IMHO you are not likely to go to trial and have the charge reduced. It will likely either be "guilty" or "not guilty." When you get to talking about reducing a DUI to a "wet reckless" you are talking plea bargain city here. Many states no longer allow this to happen at all. But some still do.
I think you would be better off to at least consult with a scum sucking dirt bag, er, sorry, I mean an attorney on this.:smt002 He can advise you which way to go. It's a darn shame this happened at this stage you your SO's life, but excrement occurs.
As others have mentioned, most companies hiring practices, have to do more with their insurance company's policies than with their own preferences. However if he can get it reduced, he might be able to get on with a construction company or something of that sort. It isn't "pretty" work, but it might be enough to get him driving and give him a few years of experience behind the wheel.

Got a lawyer, guess we'll see what comes from here. He's pretty much given up on driving but I've got my eye on whatever "dirtier" jobs I can find for him if this can get reduced. Goodness knows I've done my own dirty jobs to support us for over 3 years, just to get him to this point. So forgive me if at this point I'm...maybe a little insistent. I'm really reluctant to send him to school to learn a THIRD rejected trade....
Ya'll's advice is very good, and I appreciate it. I wish I knew more about how GA works as opposed to other states. I don't know if we can plea but that's what it sounds like the lawyer wants to do.

I'm new so obviously I don't know anything about the trucking industry but if a company does a real background check (fingerprint) they will find your DUI (Record of Arrest). This issue has come up in the airlines as all Airline employees have to do a Homeland Security check. They are only suppose to be checking for certain offenses but some of the airlines are busting pilots (and others) on stuff such as DUI's which were found on the check but would not normally be found on a regular background check. Any record of arrest will be linked to you via fingerprint forever on the NCIC computer system. Guilt, no guilt, pleads, diversion, Charges dropped, etc does not matter, the record that you were arrested will still be there.. If you were honestly found not guilty, you would have to produce proof of such.

I was a meathead back in 2003 and got a DUI. As of late, I have been considering becoming a truck driver....I retire from the Air Force in 4 months. The truck driving school here in Oklahoma says they will not accept you if you have had a DUI in the last 5 years. My state license was never suspended, but the state of California prohibited me from driving there since that is where I got the DUI. Everyone tells me to forget trying because a DUI stays on your record forever. I am no lawyer, but according to US code 49 chapter 303, I found this paragraph about your driving record:
(2) An individual who is employed, or is seeking employment, as a
driver of a motor vehicle may request the chief driver licensing
official of the State in which the individual is employed or seeks
employment to provide information about the individual under
subsection (a) of this section to the individual's employer or
prospective employer. An employer or prospective employer may
receive the information and shall make the information available to
the individual. Information may not be obtained from the National
Driver Register under this paragraph if the information was entered
in the Register more than 3 years before the request, unless the
information is about a revocation or suspension still in effect on
the date of the request.
From my take, they can request information, but if my suspension or revocation has passed, then they can only get the last 3 years....which my driving record is spotless! So, unless they do an FBI back ground check on me, there is nothing showing I had a DUI. Do companies check for a criminal record?? That would be the only thing that could bite me in the #####. Hopefully 20 years and an honorable discharge from the military will override one DUI arrest. -
I just graduated a two week mill,homework one day was to fill out apps. I told the truth dui's x2 ,simple possesion ,concealed weapon(25 loaded),school told me to redo and not tell.I got prehires, but thanks to this board I know not to lie (backround checks everywhere) NO canadaa ( can't spell) If you get a good lawyer or do research your self you might be able to get it expunged (or pardon through the govenor)$$$$$$$$$$. I just started looking for work ALL my stuff was before 1993,plus gap in enployment for the last 13 months (no jail, sick of factory work and spent my 401k). I just don't know how the small amount of driving can get you a certificate, please if your son gets a job let me know, if I get one I'll tell you. You got to remember with a cdl your (BAC drops to .04 no matter what vehicale your in). Is that right? Help me here drivers

So glad we live in Canada. You can get any non-violent criminal offense pardoned very easily and for a very small fee.
All truck drivers have to submit a criminal background check, though. -
My uncle was charged with DUI. but he took a blood test went to court and they lost the evidence (This is true I was going to testifie, nervis as h#ll,/ that I walked home for help after I drove and left him standing by a broke down truck)GOOD LAWYER.SMALL TOWN.The judge thru it out, if you blow I don't know.

Still waiting, and will be for a while now as this moves through the court system. I'll keep everyone posted, although I know there's a big difference from state to state. GA in particular seems to be pretty archaic. It also has a lot to do with the county in which the arrest takes place, and this county is really known for poor police service and money-grubbig practices. Too bad we live in this county as well.
Folks, take it from me, don't go out to the bar! Invite your friends over to somebody's house, BYOB, and crash there!
