dyed fuel penalty/use

I've been told fines start at around $1000 depending on how much you got.
Is it worth the risk?
You have to get caught first and I've never been checked. -
If you call the dot in to inspect to see you bought the truck that way (basically ratting the other guy out), they should give you an exemption.
Otherwise the fine will probably well outweigh the value of the fuel, by a long shot. -
Had a friend with a diesel pickup truck pulling out from the sale barn pulling a trailer with some cows in it, DOT stopped him & checked his fuel, it had about 1/4 of a tank of farm fuel & cost him "Big Time." The cows where his, he had just bought them at the sale, he only hauls his now stock, never for hire.
Why it happened, he had forgot to fuel up the day before, so when he left home that morning it was setting on empty so he put some tractor fuel in. Since them he has never forgot to fuel his truck up, & never has put tractor fuel in it any more. -
Plus you get fined for the capacity of the tank(s), not just the amount that was left in them.

this is a commercial truck and im just interested in actual laws penalties if anyone reading this knows, not looking for truckstop guessing games or buddy stories or i heard ect, thanks guys.

It will vary by state. I have been checked here in Tn. twice in the county I live in,once in the big trk. & once in my 1 ton dodge diesel.
I asked about the fine & was told it was $100.00 per gallon based on the capacity of the tank. He said that you would be fined by the state & also by the IRS for the same amount.
This is my experience.I was clean both times,also got checked once at the Foristell Mo. scale house. -
thanks, ive learned this can fall under tax evasion per the irs if pushed, its just not worth the trouble.

Hell I got checked twice in the same day at the scales. I think they were on a kick to catch people because they were checking everyone. My partner got a 1k fine for a 53 gallon tank.

No penalty if you don't get caught. I sure as heck wouldn't go over a scale until it's gone. I've heard of nasty fines of 10K or more. In Wis. they went to a cattle auction, where farmers are known to hang out(obviously)and went around to all the trucks checking fuel and had a field day. You could probably use it up quick, as I've never heard of roadblocks checking fuel, but I wouldn't take a chance going over a scale.
