I believe this is a state law, not federal, just like talking on the cell phone, some states allow it on personal vehicle. TN just made it unlawful to talk on phone and drive, July 1st went into effect. I know NJ was thinking about making it unlawful to eat or drink coffee/soda while driving. I don't know if that passed or not. Again I think this is state law not federal.
What's Considered Distracted Driving?
When people think of distracted driving laws, they typically think of cell phone and texting prohibitions which are often explicitly listed as illegal.
However, under most distracted driving laws, police can actually pull you over for engaging in any activity that prevents you from driving safely. This can include applying makeup while driving, cuddling with your dog while driving, or even eating while driving.
Here are some examples to chew over:
- A local ordinance in Huron, South Dakota, prohibits distracted driving. The law defines "distracted driving" as "inattentive driving while operating a moving motor vehicle that results in the unsafe operation of the vehicle." This includes reading, grooming, "or engaging in any other activity which causes distractions" -- even "eating pizza," as The Associated Press reported.
- New Jersey is also considering expanding its distracted driving ban to include eating while driving. Similar to Huron's law, the bill would prohibit "any activity unrelated to the actual operation of a motor vehicle in a manner that interferes with ... safe operation," The Star-Ledger reports. Critics say it's too vaguely worded.

Not sure how recent this is but once you open the web page, check the last line on the last paragraph:
Illinois State Police - Distracted Driving Information
"Stop to eat or drink. Drive-through windows and giant cup holders make it tempting to have a meal while driving, but you’re safer when you stop to eat or drink. If you can’t avoid eating while driving, try to avoid messy foods."

In my FLD, I'm not sure you can even see me, let alone if I'm snacking on something. At 6'3" & 34" inseam, my seat is slid all the way back. I'm behind the side windows..

So much for the Cat purring away upside down on my lap under the wheel for 300 miles. Then he will get up on the dash and cook in the sunbeam for another 100. Then it will hunt in the cab believe it or not. So spouse feeds it and takes care of the hunt problem (Mouse on end of string rattling somewhere tempting back there)
Maybe next time I'll haul out a big old Shepard, pant all day, shed everywhere and sniff everything. Woe betide anyone up on fuel tank without hostile thoughts, It's going to be death by licking. IF the stranger has bad thoughts GROWL.

While there is no law specified to eating, it is technically illegal because it is distracting and could cause an accident, just like putting on make up and whatever else. I did see someone mention sneezing, I feel that one. Sometimes I sneeze so hard that my whole body tenses up and that to me is more dangerous than eating some Pringles.Intothesunset and Truckrazy Thank this.
