2. As I pointed out in a different comment on here, it's not always about whether or not you endanger someone. You may endanger the company or yourself in other ways. You came off your 34, you're pulling onto the highway, Joe Schmo barrels into the side of your truck and kills himself. By law, you must take a drug test, even if it's obvious you are not at fault, in a fatal, you must still test. Suddenly, you come back positive. Now, this changes the dynamics of the situation, police are going to go back and reinvestigate the accident, your companies insurance carrier is immediately going to be put on the defensive, and most likely the family of Joe Schmo are going to find some ambulance chaser to take the case and sue your company. Maybe the ambulance chaser prevails, maybe he doesn't, of course it won't matter to you as your still jobless, regardless, your carrier's insurance company is going to have to defend the carrier, they don't do it for free. Say they spend $100,000 to defend the company and prevail, your carriers insurance is going to go up next year, of course it won't matter to you, as you won't be employed there anyhow, or anywhere for that matter. Or maybe, they spend $100,000 and a Jury decides that your company needs to be taught a lesson for not doing a better job of drug testing their employees, and orders the company to pay out $1 million in damages. Now that carriers insurance is going to get hit for a double whammy. Oh, and it's very likely that the ambulance chaser is going to personally sue you at the same time they sue the company. Yes, the carriers insurance is going to defend you, but why put them in that position. Also, now instead of only having that positive test on your CSA history, you will also have a fatal accident tied to that positive test. You think 5 yrs is a long time, try that one on.

So I reached out to someone who works in a drug rehabilitation clinic. She told me that when they have patients that are truckers, they have different SAP programs. Some are just weeks long but it's very aggressive. This particular clinic is in Mobile, AL. Do you any of you know of how long a program has to be before a driver can return to duty? Is it like when a new driver starts in the industry, and most companies require 160 hours in a school?

While driving under influence is, of course, deplorable and should not be tolerated, the rules aren't fair for recreational pot smokers. Especially, that it is legalized everywhere or almost.
It appears that the difference, from the perspective of drug abuse policies, between an alcoholic drink and smoking a joint only consists in the aftermath of physiological process of body getting rid of toxic substances. Alcohol
connoisseurs, after relatively short period of time, will leave no trace of their indulgements in their bodies, while Marijuana users will be considered abusers because the toxic particles won't evaporate as quickly as the alcoholic ones.
Ideally, the drug policies should ensure that driving under influence is prevented, without banning the accessibility to legal enjoyments.
Maybe one day...
P.S. Therefore, I have to wait until I retire to see what sort of enjoyment a Marijuana joint can offer...loudtom, Opendeckin, Gearjammin' Penguin and 1 other person Thank this.
