Correct, if you are required to load piece and count the trailer, or tarp then you have to log on duty. Otherwise when the customer asks you to leave the truck and wait in the waiting room/lounge you are off duty.

This quote is from the FMCSA's web site that has a new booklet called Interstate Truck Driver Guide to HOS.

On-Duty Time In a Commercial Motor Vehicle

EffectiveFebruary 27, 2012, the Federal Motor Carrier Safety Administration excluded from the definition of on-duty time any time resting in a parked commercialmotor vehicle, with the driver relieved of all responsibility for the vehicle.

Bayle you forget the words of with the driver relieved from all responsibility forthe vehicle in your quote. In dock you still have responsibility.

What Is Off-Duty Time?
By understanding the definition of on-duty time, you will get a good idea of what is considered off-duty time. In order for time to be considered off-duty, you must be relieved of all duty and responsibility for performing work. You must be free to pursue activities of your own choosing and be able to leave the place where your vehicle is parked.

If you are not doing any work (paid or unpaid) for a motor carrier, and you are not doing any paid work for anyone else, you may record the time as off-duty time.

Since currently we are required to be with the truck while it is being unloaded or loaded and can not leave the area to pursue other activities it means that they can hold us to line 4 while in the dock. We are technically still doing work for the company. Now I agree that we should be able to log sleeper time if we are in the sleeper actually resting while loading/unloading and I know that we all log sleeper berth but things could get sticky in the future. I sure the companies are going to come up with something since being on line 4 cuts into a driver's daily productivity therefore the company's bottom line.

After I check in at con or shipper I'm not staying on duty even if the rules are written in bold writing or in plain english period.

I thought it said in the FMCSA that no one except the driver is allowed to edit logs. So how is it that the Safety Dept. can edit for you?

If their going to make us log ON DUTY for all our time at a ship or cons, than I think we need to start getting paid by the hour. Or about $5.00 a mile

So what we do is require drivers to submit a form. counts as an electronic signature for log changes. Pair that with the logs and presto chango requirement achieved.
