Now that is the brilliance, or rather the lack thereof, I have come to expect in the trucking industry. I would have just did an off duty driving (personal conveyance) to the truck stop if empty. Old dispatch completed, not under a new dispatch, not doing anything for the company or related to trucking commerce. No brainer. Would not have interrupted any break that was going on in the E-logs. Have done it several times.
New ELD mandate, no different. Nothing about the ELD mandate eliminates personal conveyance moves.

Exactly. That is either a dumb driver that doesn't j understand the basics of hos, or a driver trying to play hardball with the customer and his carrier. Either way, if one of my guys ever pulled that id send the tow truck no problem. But it wouldn't be to tow the truck to a truck stop. If have them tow it to their secure lot, and be on my way to pick it up. That idiot of a driver could find his own way home.

Then you would lose the wrongful termination lawsuit he should file against you. It's illegal to drive off duty except for very specific reasons, 1 is finding restaurants in the area. 2 is using the CMV to go to/from the terminal. Not from warehouse to truck stop, but terminal to home and back. Moving off the lot is NOT legal no matter how one wishes it was. Isn't going to a truck stop the same as finding a restaurant? Most truck stops I have seen in the last 50 years have had some form of restaurant or food bar at them. The above situation we are talking about meets the criteria... relieved from responsibility for performing work (no load, no dispatch). And what of those of us that do not have a carrier "terminal" and drop a trailer in town and bobtail to a rural home? The trailer drop is technically the "terminal" for those of us that own the truck. While some from of wrongful termination may apply, your contention does not fit in that category. You are trying to make a case that is picking apart details based on a slimmer criteria than outlined in the guidance.

It also plainly states a driver placed out of service can't drive to any location for rest. So safe to drive if you haven't been placed out of service by a dot officer. It's very plainly written, and only nit picky company drivers can find something to suit their agenda. Myself? I'll accept the written clarification of the rule the fmcsa applied to my carrier. If i get a ticket it will be dismissed just by facing over a copy of that fmcsa letter.Last edited: Nov 4, 2016

What brand/model is you ELD?
I have heard that some ELDs start recording after 5 mile of travel and after speed goes above 20 mph. Yours is that type of ELD? Recorded gps data for stops shows City/town names or geo coordinates ? -
It's the jj keller. And it does record after a few miles. Which is why i log out. The box is still connected and recording everything of the ecm and tracking with its gps and will send that info to the head office the next time i log in. But it's not showing on the log on the tablet with the actual drivers log, which is why making the remark of what you did off duty why you did it and how far you did it is important.mhyn Thanks this.

You will have to have a separate login for admin duties. Any edits are required to be obvious in how they are displayed.
Here you can see where one of our mechanics wasn't able to login in the morning so I adjusted his time to his actual start time. Compliant ELD software will have to show what this does, both edited and unedited versions.Attached Files:
